Boombaland Terms of Service (End User Licence Agreement)
Effective date: 21 October 2026 Last updated: 26 October 2026
Hello! These terms are the rules for playing Boombaland. They are a contract between you and DataSight (Tom de Bruijn), Tulameenpad 10, 1461 HN Zuidoostbeemster, the Netherlands ("we", "us"). By downloading or playing Boombaland you agree to them. If you are under 18, please read them with a parent or guardian, who agrees to them for you.
The short version
- You may play Boombaland for fun on your own devices. Please don't cheat, hack or copy it.
- Coins, gems, energy, keys, chests and every other in-game item are part of the game. They have no real-money value, and they cannot be cashed out, sold or traded.
- Purchases and refunds are handled by Apple or Google, under their rules.
- Before you open a chest you paid for with gems, the game shows you what it can contain and the odds.
- In Belgium, chests cannot be bought. You can still open chests with keys you earn by playing.
- The game is provided "as is". Your legal rights as a consumer are not affected.
1. Apple's standard terms (iPhone and iPad)
If you got Boombaland from the Apple App Store, Apple's Licensed Application End User License Agreement applies together with these terms: https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. If the two conflict, these terms win where Apple allows it. Apple is not responsible for Boombaland or for supporting it; we are. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
If you got Boombaland from Google Play, Google Play's Terms of Service also apply to your use of the store.
2. Your licence
We give you a personal, non-exclusive, non-transferable, revocable licence to download Boombaland and play it on devices you own or control, for your own non-commercial entertainment, as the store's rules allow (for example Apple's Family Sharing). We, and the people we license from, keep all rights in the game, its characters, art, sound, code and trademarks. Some parts are open-source or third-party software under their own licences: see Settings › About › Credits and licences in the game.
3. Who can play
Everyone is welcome. Children should play with a parent's or guardian's permission, and purchases by a child need a parent's permission. Please use your device's parental controls (Apple Screen Time and Ask to Buy; Google Family Link and purchase authentication).
4. Playing fair
Please do not:
- cheat, use bots, or change the game's save files or code to get items or progress you did not earn;
- copy, modify, decompile, reverse-engineer or redistribute the game, except where the law allows it anyway;
- exploit bugs on purpose;
- use the game to break the law or anyone's rights;
- use a player name that is rude, hateful or someone else's personal information;
- change your device's clock, or speed up the game, to get rewards early. The game checks the time and simply holds daily rewards until the real time catches up.
5. Virtual items and currencies
Boombaland has in-game items, including coins, gems, energy, keys, chests, gear materials (such as Feathers, Tree Sap and Pinecones, and Enchanted Leaves), hero shards, heroes, gear, boosts, avatars and frames, and the No Ads and Unlimited Energy unlocks ("Virtual Items").
- Virtual Items are a licence, not property. When you earn or buy one, you get a limited right to use it in the game. You do not own it.
- They have no cash value. They cannot be exchanged for real money, goods or services, and cannot be sold, traded or transferred to another player or outside the game. We never buy them back.
- Coins and gems cannot be exchanged for each other.
- Bought coins and gems do not expire while the game is available.
- Energy refills over time. Watching an optional rewarded ad or spending gems can give you more.
- Your items live on your device, with a copy in your cloud account if you turn one on (iCloud, Google Play Games, or Cloud save across devices). If you delete the game, reset your device or lose it without a cloud copy, your progress and items may be lost, except that permanent purchases (No Ads, Unlimited Energy, and heroes bought with money) can be restored with Settings › Account › Restore Purchases on the same Apple ID or Google account. Coins, gems and energy you bought are consumed when delivered and cannot be restored.
- We may change, balance, rename or remove Virtual Items (for example, change prices in gems, or what a chest contains) to keep the game fun and fair. We will not remove an item you paid real money for without giving you a fair alternative or, where the law requires it, a refund.
6. Chests and their odds
Some chests contain random rewards. You get chests with keys, which you earn by playing and which are never sold. Some higher-tier chests (Epic and Legendary) can also be bought with gems.
- Before you buy a chest with gems, the game shows its odds: the chance of each rarity, and the coins, shards, gems and materials it always or can contain. You can then buy it or cancel. (Shop › chest › odds panel.)
- No chest can be bought directly with real money; real-money purchases always give a fixed, stated amount.
- Belgium. In Belgium, chests cannot be bought, with gems or with money. Keys and chests you earn by playing still open as usual. We decide whether you are in Belgium from the country of your App Store or Google Play account, not from your location. Until the store tells the game your account's country, no chest is offered for sale.
7. Purchases, prices and refunds
- All real-money purchases go through the App Store or Google Play, at the price shown there. The store converts prices for your country. Their payment terms apply.
- Refunds are handled by Apple or Google, not by us, because we never receive your payment details.
- Right of withdrawal (EU). Virtual Items are digital content delivered immediately. When you buy one, you ask for it to be delivered straight away, and you agree that you then lose your 14-day right of withdrawal once delivery has started. This does not affect your rights if something you bought is faulty or not delivered.
- If a purchase did not arrive, try Settings › Account › Restore Purchases. If it is still missing, ask the store for a refund (links above), or use our contact details in section 15 with the store's receipt.
- The No Ads unlock removes the optional ads and lets you claim their rewards without watching; the daily limits on those rewards still apply.
8. Ads
Boombaland can offer optional rewarded video ads from Google AdMob. You choose whether to watch one, and you get the stated reward if you watch it to the end. Ads are subject to our Privacy Policy.
9. Changes, updates and availability
We may update Boombaland to fix problems, add content or change features, and some updates may be needed to keep playing. We may stop offering the game or some of its features. If we close the game, we will tell you in advance where we can, and stop selling Virtual Items at least 30 days before.
10. Ending these terms
You can stop at any time by deleting the game. We may suspend or end your licence if you seriously or repeatedly break these terms. When it ends you must stop using the game, and your Virtual Items end too. Sections 5 (no cash value), 11, 12 and 13 continue after it ends.
11. Our responsibility to you
- Boombaland is provided "as is" and "as available". We work hard to make it fun and bug-free, but we cannot promise it will always work without interruption or errors.
- To the extent the law allows, we are not liable for indirect or consequential losses, or for lost Virtual Items that were not bought with real money, and our total liability to you is limited to the amount you paid us for the game in the 12 months before the claim (or €50 if that is more).
- Nothing in these terms limits liability that cannot be limited by law, such as for death or personal injury caused by negligence, fraud, or your statutory rights as a consumer (for example under Dutch law, Book 7 of the Dutch Civil Code, Burgerlijk Wetboek, on consumer sales and digital content).
12. Health
Video games can include flashing lights and fast-moving images. If you or your child has epilepsy or has had a seizure, talk to a doctor before playing. The game has a Reduced motion option in Settings. Take breaks.
13. Law and disputes
These terms are governed by Dutch law. Disputes go to the competent court in The Hague (Den Haag), the Netherlands. If you are a consumer living in another EU country, you also keep the protection of the mandatory laws of your country, and you may bring a claim in your own country's courts. The EU's online dispute resolution information is at https://consumer-redress.ec.europa.eu.
14. Changes to these terms
We may change these terms. We will update the date at the top and post them at https://www.boombaland.com/terms/. If a change matters, we will also tell you in the game. If you keep playing after a change takes effect, the new terms apply.
